Terms of service
These terms apply to anyone who uses SmartPark: residents, guests, strata council members, property managers and patrol officers. By using SmartPark you agree to them. Your building may have its own parking bylaws and rules as well; where they apply, they are your building's, not ours.
What SmartPark is
SmartPark is software that a building's owners' association — a strata corporation, condo corporation or homeowners' association (HOA) — uses to run guest parking, patrol and parking fines. In these terms we call it "the association". SmartPark provides the tools. The association sets the rules — how many passes residents get, what fines are, and whether a fine is confirmed or waived. SmartPark does not decide any fine.
Accounts
- Accounts are created by invitation. Keep your password to yourself; you are responsible for what happens under your account.
- Give accurate information, including the licence plates and phone numbers you enter for guests. Only enter a guest's details if they have agreed to receive a pass by text.
- Tell us straight away if you think someone else is using your account.
Guest passes
A pass lets a guest park in your building's visitor parking for the time shown, under your building's rules. A pass is not a guarantee that a space will be free. Your building decides how many passes you can issue and for how long.
Patrol and fines
- Fines are issued under your building's bylaws and the laws that apply where it is. You will receive a written notice and the chance to respond or ask for a hearing before the council decides.
- If the council confirms a fine, it is charged to the payment method on your account. If your building offers it, you may pay early at a reduced amount.
- Questions about whether a fine was fair go to your association's council or board, who make that decision.
Payments
Payments are processed by Stripe. By saving a card you allow SmartPark to charge it for fines the council confirms and for anything else you choose to pay for in the app.
Using SmartPark properly
Don't misuse SmartPark: don't try to get into other people's accounts or data, interfere with the service, issue passes to get around your building's rules, or use it for anything unlawful. We may suspend an account that does.
Availability
We work to keep SmartPark running, but we can't promise it will never be unavailable. Patrol scanning keeps working without a connection, using the latest copy of the building's passes on the officer's phone.
Liability
To the extent the law allows, SmartPark is not responsible for parking decisions made by your association, for towing, or for losses that come from information entered incorrectly.
Changes
We may update these terms. If a change matters, we will tell you in the app or by email before it takes effect.
Law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
